2.1 Account Information and Anonymity: Users maintain complete control over their account information and may use pseudonyms, aliases, or anonymous identifiers at their sole discretion; modify, update, or change account information at any time without notice; maintain multiple accounts subject to these Terms; and choose what information to provide or withhold, except as required for legal compliance. The Platform does not require real name verification, permits anonymous and pseudonymous participation, will not verify user identity except when legally required, and makes no representations about user identity authenticity.
3.1 ABSOLUTE USER RESPONSIBILITY AND LIABILITY: USERS ARE SOLELY, COMPLETELY, AND EXCLUSIVELY LIABLE for ALL content they post, upload, share, transmit, distribute, or otherwise make available through the Platform. USERS ASSUME ALL LEGAL RESPONSIBILITY AND LIABILITY including but not limited to civil liability, criminal liability, regulatory liability, and any claims for defamation, intellectual property infringement, privacy violations, fraudulent misrepresentation, breach of contract, violation of laws, harm to others, economic loss, or any other legal claim whatsoever. THE PLATFORM BEARS ABSOLUTELY NO RESPONSIBILITY OR LIABILITY for user content under any legal theory.
Users may upload and sell property-related documents. All pricing, availability, transaction fees, and marketplace terms are subject to Platform policies which may change at any time without notice. THE PLATFORM MAKES NO WARRANTIES OR REPRESENTATIONS regarding documents, their accuracy, authenticity, completeness, legality, or fitness for any purpose. The Platform does not verify documents and is not liable for any damages arising from document use, purchase, or reliance. ALL DOCUMENT TRANSACTIONS ARE FINAL AND NON-REFUNDABLE.
The Platform reserves absolute and unfettered discretion to remove, disable, or restrict access to any content at any time, with or without notice, for any reason or no reason, including but not limited to: violation of Terms, legal compliance, court orders, intellectual property claims, harm prevention, technical reasons, business interests, user complaints, or our sole discretion without any reason whatsoever. The Platform has no duty to monitor or remove content and may leave allegedly violating content accessible. Non-action does not constitute approval. We may remove content without notice, warning, or explanation.
THE PLATFORM AND ALL SERVICES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND. We expressly disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, or meeting your requirements. THE PLATFORM DOES NOT PROVIDE LEGAL, FINANCIAL, TAX, REAL ESTATE, INVESTMENT, OR ANY OTHER PROFESSIONAL ADVICE OR SERVICES. Any information available is for general informational purposes only.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FOR REAL HOMES LLC OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, including lost profits, revenue, data, business opportunities, goodwill, emotional distress, property damage, or any other damages whatsoever. This limitation applies regardless of legal theory, whether we knew of potential damages, whether remedies fail their essential purpose, and to the maximum extent permitted by law. If any liability is imposed, our total cumulative liability shall not exceed $100 or amounts paid in the preceding 12 months, whichever is less.
YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS For Real Homes LLC and all affiliated parties FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, LOSSES, COSTS, AND EXPENSES (INCLUDING ATTORNEYS' FEES) arising from or related to: your use of the Platform, your content, violation of these Terms, violation of any laws or third-party rights, disputes with other users, account access, or any other acts or omissions by you. We reserve the right to assume exclusive defense of any matter at your expense. This indemnification survives termination indefinitely.
ANY AND ALL DISPUTES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING INDIVIDUAL ARBITRATION rather than in court, except for small claims court matters. Arbitration shall be conducted by the American Arbitration Association in Miami-Dade County, Florida under Florida law. YOU AND WE AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING. YOU ALSO WAIVE ANY RIGHT TO A JURY TRIAL.
By posting content, you grant us an irrevocable, perpetual, non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, create derivative works from, distribute, publicly display, publicly perform, and otherwise exploit your content in any media for any purpose without compensation. This license survives account termination.
You waive all known and unknown claims existing as of accepting these Terms. You waive California Civil Code Section 1542 and similar laws. You waive all consumer protection statutes to the maximum extent permitted. You waive any right to equitable relief. You waive all moral rights in your content. You release all Indemnified Parties from all claims related to Platform use.
You may terminate your account at any time. We may suspend or terminate accounts at any time, with or without cause or notice, in our sole discretion. Upon termination, your right to use the Platform ceases immediately. All provisions intended to survive termination shall remain in effect.
Users may not: violate laws or third-party rights, post illegal content, harass others, post hate speech, share inappropriate imagery, engage in fraud, infringe intellectual property, post spam, attempt unauthorized access, scrape data, circumvent fees, impersonate others, upload false documents, engage in financial crimes, or use the Platform for any unlawful purpose.
Your use of the Platform is subject to our Privacy Policy, incorporated by reference. You consent to all data practices described therein.
We respond to valid DMCA notices. To report infringement, provide required DMCA elements to mgmoss@johnsonmosslaw.com with subject "RHP DMCA Notice". Counter-notices may be submitted for wrongful removal. We may terminate repeat infringers.
16.1 Governing Law: These Terms are governed by Florida law without regard to conflict of law principles. For non-arbitrable disputes, you consent to exclusive jurisdiction in Miami-Dade County, Florida courts. 16.2 Severability: If any provision is unenforceable, it shall be modified to the minimum extent necessary. All other provisions remain in full effect. 16.3 Entire Agreement: These Terms and incorporated policies constitute the entire agreement. We may modify these Terms at any time without notice. Continued use constitutes acceptance. 16.4 Survival: All disclaimers, limitations of liability, indemnifications, arbitration provisions, and waivers survive termination indefinitely.
